GEORGIA – Car crashes are stressful and sometimes tragic. However, they are also common. According to the Georgia Department of Transportation (GDOT), 1,507 people died in collisions in the state in 2019. Of course, that number only describes the very worst collisions and not the many other wrecks that leave people injured or damage their property.

In some instances, drivers involved in crashes in Georgia are not native to the state. For victims of car accidents who were injured by out of state drivers, there is often a question as to how the other person’s residency will impact their Georgia legal claim. As such, it is important for people in this situation to know that a person injured in an automobile accident in Georgia can file a claim against an out of state driver.

Drivers who enter the state are also required to follow Georgia’s traffic laws. If an out-of-state driver causes an automobile accident in Georgia due to negligence, injured victims can pursue claims against them within the state. However, where the accident occurred within the state in such instances can determine the requisite venue to bring the claim, and if the damages are high enough, the case could be removed to Federal Court. Even in such instances, Federal judges would generally have to apply Georgia law.

Depending on the state in which an accident occurrs, insurance laws can vary. Georgia drivers must hold $25,000 in injury coverage per person and $50,000 per occurrence, plus $25,000 in coverage for property damage. In some instances, a driver who causes a crash will be uninsured or underinsured. In these cases, the injured driver must rely on their own uninsured/underinsured motorist coverage.
