Generally, the spouse or children will be the parties that bring a wrongful death claim involving an adult, but a spouse who brings the action must share any recovery with the minor children of the decedent. The surviving spouse who files a wrongful death lawsuit is entitled to no less than one-third of the recovery, but the proceeds must also be shared with the decedent’s children.
