Our Attorneys Know What it Takes to WinTM Motorcycle Accident Cases

Billions Recovered for Accident Victims*

Unfortunately,  statistics clearly demonstrate that the hundreds of thousands of motorcyclists in Georgia face a much higher rate of injury and death  compared to individuals traveling in cars. In fact, the likelihood of dying in a motorcycle accident is 27 times higher than the chance of being killed while traveling in a car.  The increased risk faced by motorcyclists is no great surprise considering that, in contrast to individuals riding in cars, motorcyclists are not protected by a steel frame, airbags, seatbelts and other safety and structural features.  In addition, motorcycles are smaller than and not always as visible to drivers of cars.

For motorcyclists, the added risk is one they accept in exchange for the freedom offered by riding a motorcycle. However, the fact that motorcycles are not as safe as cars does not change the fact that motorcyclists injured by negligent drivers can pursue claims for damages against those responsible for their injuries.  Tragically, the injuries sustained are often very serious, extremely expensive, and at times, life-altering and permanently debilitating.  At Montlick & Associates, we have 39 years of experience representing individuals injured while riding motorcycles in and around Albany, Georgia, as well as throughout the Southeast.

Negligence and Motorcycle Accidents in Albany, Georgia

When a collision between a car and a motorcycle accident occurs, it is most often the result of negligence.  Negligence occurs when a person does not act as a reasonably prudent person would under the circumstances. In the case of individuals operating vehicles on the road, a duty is owed to drive or ride reasonably, in order to avoid causing an accident with other motorists or pedestrians.

A mere moment of carelessness can cause an accident. For example, if a driver is texting, speeding, violating a traffic law, driving recklessly or changing lanes without looking carefully for other vehicles, an accident can result. If a driver of a car is negligent, and causes a collision that injures a motorcyclist, the motorcyclist can normally collect compensation from the negligent driver.

Motorcycles and Comparative Negligence in Albany

The cause of a collision is not always clear cut. It is possible for an accident to be the result of the negligent acts of many people, including the person injured. Under Georgia’s law, when an injured person is partially responsible for their injury the court will compare the negligence of the parties and assign a percent of responsibility to all of the parties involved. If the injured person is less than 50% responsible for the accident, then they are able to collect compensation that will be reduced by their share of the liability. For example, if a motorcyclist was involved in a collision with a car, and the motorcyclist is found to be 40% liable, and the driver was 60% liable, the motorcyclist would be able to collect 60% of the total damages that he or she suffered. Thus, if a court concluded that the damages were $100,000, the motorcyclist would be able to collect $60,000.
