Wrongful Death Lawyers Macon Trusts

Justice For Your Loved One

The unexpected death of a loved one is always tragic–and the trauma and grief only increase when the accident was caused by someone else’s carelessness or negligence.

The unfortunate truth is that many fatal accidents are preventable. If someone in your family was killed in an auto accident, or by workplace negligence, aggression, or other actions by a third party, you may be able to pursue a wrongful death claim. While of course nothing can truly compensate you for the loss of your loved one, a wrongful death settlement can help to ease the financial burden of your loss and hold the responsible parties accountable.

Pursuing a legal claim is probably the furthest thing from your mind right now as you grieve your loved one. That’s why Montlick is here. Our compassionate attorneys handle all aspects of your case for you and ensure that your legal rights are protected, so you can concentrate on yourself and your family during this difficult time.

Montlick and Associates at Executive Park in Atlanta, Ga have been the most professional and customer service oriented firm I've had the pleasure of working with despite the circumstance I was in. They were able to assist me with 1 case successfully in December 2019.I recently needed additional assistance in October 2023 for a 2nd case. This time Montlick and Associtates could not directly assist me due to the nature of my request, but they were able to point me into the right direction on where I can receive attorney services. That was such a huge relief! Thank you to Nick Vocino and his office and team!
I couldn’t have chosen a better law firm to handle the case of my accident which was not my fault! Jason Saltzman was my attorney and he was amazing and he didn’t leave any stones unturned! He worked for the absolute most for me and got me the care I needed ! And Esmeralda, his senior legal assistant, was always there when I had questions and would always email me back very quickly if I had questions and she and Jason really put my mind at ease while going through all of this ! He got me the maximum of what I deserved and worked hard on my case! I’d give them 100 stars if I could because they are the best! I’d recommend them anytime any day for anyone who needs an attorney who cares and one that will answer you no matter what and answer any questions that you may have ! Thank you so much Jason and Esmeralda !!!!⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️⭐️

Generally, wrongful deaths can be divided into two broad categories:

Negligent Conduct: Normally, Georgia wrongful death law defines wrongful death in such cases as a fatality caused by the failure of an individual to exercise reasonable care. There are many types of unsafe behavior that can create hazards and cause accidents, such as car and truck accidents including distracted or reckless driving, construction accidents, negligence by healthcare providers,  slips trips and falls, accidents involving defective products, and more.

Intentional Misconduct: These cases typically involve criminal activity, such as murder, vehicular manslaughter, elder abuse and similar types of criminal acts that cause a fatality. When a wrongful death is the result of a criminal offense, the responsible party typically will face a criminal prosecution, but the civil process (what we do) provides an avenue for obtaining financial compensation for the victim’s family.

Who can bring a wrongful death claim?

Georgia wrongful death claims generally will be brought by a surviving spouse, or if there is no surviving spouse, the action may be brought by a surviving child. Even if a spouse brings the action, the proceeds of the wrongful death lawsuit also must be shared with children of the decedent (O.C.G.A. §51-4-2).

The percentages distributed between a surviving spouse and the children of the decedent depends on the number of children so you should ask an experienced Macon wrongful death attorney about the appropriate distribution in your case.

Finally, if there is neither spouse nor children of the deceased, the right to compensation goes to the decedent’s surviving parents and, if there are no living parents, then to the decedent’s estate.

Under Georgia wrongful death law, there are three general categories of damages that can be available in a legal action involving a fatal injury:

  • Medical, funeral and other necessary expenses stemming from the injury or death of the decedent (O.C.G.A. §51-4-5(b))
  • Full value of life of the decedent (O.C.G.A. §§51-4-2(a), 19-7-1(c)(1)).
  • Pain and suffering, medical bills and other damage arising between the time of injury and death (§9-2-41) (This portion of the wrongful death case is referred to as a “survival action.”).
