Ellen Forrester and Nicole Casorio are the best in the business.Incredible professionalism, honesty and efficiency. Not only was Ellen 100% accurate on her assessment of my case, she was also a straight shooter.Nicole thank you for your patience and help in navigating this stressful process.10/10
Since Covid, I’ve been in 3 hit-and-run accidents in which neither were my fault. I had a different attorney represented me in the first accident who was not very attentive nor responsive to my numerous calls and questions. For my second and third accident, I decided to go with Montlick and Associates, specifically Attorney Cate Powell. Cate, returned my call; she listened, took notes, allowed me to vent about chronic pain I was experiencing and after finding out that the other driver almost got out of paying the liability claim due to a technicality, Cate assured me that she had everything under control. Unlike my first attorney, she not only provided updates but she checked on my recovery as well; and if she was unable to personally update me, she allowed her team to provide an update. Cate is a fighter for her clients, she even dealt with my insurance to ensure that I received everything that was owed to me. And she also represented my husband as well. She is now someone I trust wholeheartedly, and if I ever have a legal matter, I can call her for help and if she can’t represent me, she will certainly point me in the right direction. So, if you’re ever in an accident and seeking legal representation, and need a no-nonsense attorney, call Attorney Cate Powell because I am telling you from experience – she would be your one call that would fully represent you. Trust me!
Hi I would like to thank Scott Patterson for everything for helping me with my case. He is a nice and terrific guy.
After a terrible accident, we turned to Ellen Forrester at Montlick for help with my mom's case. She walked us through everything step by step, handled the documentation and when it came time, her colleague, Mike Moran, and her represented my mom amazingly at mediation. While we are very happy with the settlement reached, this process was so much easier with their care and guidance. We will forever recommend them and Montlick to anyone.
Cate Powell and her team did excellent job at getting me the help I needed. They referred me to a great medical facility for treatment. Any questions I had was met with a quick response and I was always up to date on what was happening. They made the process as easy as possible for me. I would highly recommend using Cate Powell with montlick and associates.

My attorney did his job. He helped me and listened to me. He was a blessing to have as my attorney.
When it comes to personal injuries being handled with upmost quality care, professionalism and determination to resolve all legal woes quickly and successfully. I'll be the first in a very long line of satisfied customers to say that Monica Pearson, (one of Atlanta's great Black female broadcast journalists and the first, former WSB-TV evening anchor at Channel 2 Action News) who I truly admire was right on the money (meaning trustworthy) for informing all victims of negligence to seek legal help from a proven law firm such as Montlick & Associates, who I call the best of the best LEGAL STRONG ARMS in the personal injury business!I'm a client of this wonderful establishment who truly took care of all my needs relating to my unfortunate accident, all due to a distracted driver who paid dearly for his poor driving ability. In saying that, I must recognize two important people at the firm. One is legal assistant Amber Starks (a marvelous paralegal) who kept my spirit up while I dealt with my personal recovery. Amber Starks is fantastic person to know, and second is my attorney, the incredible Nick Vocino. I call him a "legal eagle battling ram" for the underdog against vicious insurance companies. He's terrific! Nick "The Battle Ram" Vocino is "no joke" when it comes to him protecting his clients, he's fabulous! And last but also first is the entire staff at Montlick, who made me feel like one of their family members, just splendid! Alright people, I stated I was recognizing two, but I ended up acknowledging four. Monica Pearson, Amber Starks, Nick Vocino and the staff at Montlick; thank you for all that you have done and still do. All of you have earned my respect and deserve a round of applause from your clients. Ladies & gentlemen, I appreciate you for a job well done. Many blessings I send to you.
I had a wonderful experience with Montlick and my lawyer Nick Vocino. He was very efficient and always available if I needed him. I would recommend Montlick and Nick V. to anyone who needs help after an accident!

I cannot say enough good things about Ellen Forrester and Dayna Clark at Montlick. They took an awful incident and walked me through the process of getting the care I needed and knowledge to help pay for expenses and get a reasonable claim to help me and my family. I have recommended them to others and definitely recommend them to those looking for an attorney that listens and treats you like a person.

Know Your Legal Time Deadlines

It is vital to act before the statute of limitations passes. There are many factors that can affect the amount of time you have to file a claim, which can vary depending on the location of the incident, the ages of those involved, and more. A qualified personal injury attorney can evaluate the facts of your unique situation to determine legal and insurance time deadlines. Waiting too long to act could result in you giving up the right to pursue compensation altogether, so best practice means contacting a highly-skilled lawyer to help determine your status as quickly as possible after the incident.

How Long Do You Have to File a Medical Malpractice Lawsuit in Atlanta, Georgia?

Support is Only a Call Away

Contact Montlick Now

In general, Georgia law gives victims two years from the date of injury or death to file a medical malpractice lawsuit. The clock on this two-year window starts from the date of the negligent act. However, there are also notification deadlines for claims against government entities, some that can be as short as six months. That’s why if you believe you or a family member has a claim, you should contact us immediately.

Exceptions for minors
The statute of limitations window for medical malpractice against a minor cannot run out before a child’s seventh birthday. So, a child can still sue up to the age of seven, even if they were injured more than two years ago.

The statute of repose also cannot run out before a child’s tenth birthday, so they can sue up until age ten even if five years have passed since the treatment that caused their injury.

Common Medical Malpractice Examples

Claims arising out of medical malpractice are not necessarily restricted to doctors and can extend to physician assistants, nurses, nurse practitioners, therapists, dentists, and include medical specialists, such as dermatologists, neurosurgeons, cardiologists, urologists, etc.

Common types of medical malpractice include:

  • Miscalculation of dosage when administering drugs
  • Infections caused by unsanitary equipment or instruments
  • Failure to diagnose
  • Objects left in the body following surgery leading to complications
  • Anesthesia errors
  • Failure to properly monitor a patient
  • Improper or delayed diagnosis due to a lack of medical tests
  • Ignoring a patient’s documented medical history leading to an allergic reaction to drugs

The Scope of Medical Malpractice

Medical malpractice happens more often than most people realize. Each year thousands of cases are reported due to negligence involving surgery, misdiagnosis, overprescription, poor aftercare, premature discharge, and more. In the United States, medical error results in 10% of all deaths. The reality of medical malpractice claims is startling:

  • 21% of people have experienced medical errors
  • Approximately 33% of medical malpractice claims are misdiagnosis errors
  • Nearly 4,000 surgical errors occur yearly in the US
  • Between 15-18,000 lawsuits are filed each year alleging malpractice or negligence

What Types of Damages are Recoverable in Atlanta in a Medical Malpractice Case?

A plaintiff in Georgia can seek monetary damages for costs incurred due to medical malpractice. These include the costs of additional medical care, as well as compensation for lost wages and more.
Victims can also seek non-economic damages for pain and suffering. A malpractice personal injury attorney helps plaintiffs tell their stories, clearly defining pain, suffering and injuries that would not have happened within the normal course of medical care. In cases of gross negligence or recklessness, a jury can also award punitive damages for medical malpractice. In the state of Georgia, a plaintiff can seek punitive damages if they can prove their medical provider was guilty of any of the following:

  • Willful misconduct
  • Malice
  • Fraud
  • Wantonness
  • Oppression
