Montlick Injury Attorneys Atlanta Ticket Promotions Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCE OF WINNING.

ELIGIBILITY: The Montlick Atlanta Ticket Promotions (the “Promotions”) are open only to legal residents of the State of Georgia whose primary residence is within a seventy-five (75) mile radius of Mercedes-Benz Stadium in Atlanta, Georgia (the “Territory”), and who are twenty-one (21) years of age or older at the time of entry (the “Entrant”). Owners, managers, and employees of Montlick Injury Attorneys, P.C. (“Sponsor”), AMB Sports and Entertainment, and each of its and their respective parent companies, subsidiaries, affiliates and related companies, advertising and promotion agencies, participating venues, and agents, as well as the immediate family (spouse, parents, siblings and children) and household members of each such person and any others engaged in the development, production, execution or distribution of the Promotions (collectively with Sponsor, the “Released Parties”), are not eligible to participate. Promotions are subject to all federal, state and local laws and regulations. Participation in the Promotions constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to this Promotion.

HOW IT WORKS: The Promotions consist of multiple independent sweepstakes taking place in the Territory. Each of these sweepstakes (each, a “Sweepstakes”) is conducted independently of the other Sweepstakes included within the Promotions, and each has its own entry periods, drawings, and prizes. The Promotions are void where prohibited.

SWEEPSTAKES ENTRY PERIOD: The entry period for each upcoming Sweepstakes (each, a “Sweepstakes Period”), and the Prizes available in that Sweepstakes will be included with the respective Sponsor Sweepstakes Post (defined below), which may be within the accompanying caption.

REQUIREMENTS FOR ENTRY AND TO WIN: To enter a Sweepstakes, you must have either an Instagram or TikTok account that is set to public or unprotected and follow Sponsor (@montlicklaw); creating an account is free but is subject to the applicable terms and conditions of the platform. If entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply.

If you are selected as a potential winner, you must have a valid, working email address, and you must have a Ticketmaster account (or be willing to create one, which is free but requires that you have both a valid, working email address and a working phone number).

TO ENTER A SWEEPSTAKES: Sponsor will publish a post on Instagram and on TikTok advertising each Sweepstakes (each, a “Sponsor Sweepstakes Post”). To enter a Sweepstakes, during the applicable Sweepstakes Period:

    On Instagram:

    • Like and reshare the Sponsor Sweepstakes Post to your Instagram story and tag @montlicklaw (this gets you one (1) entry and may only be utilized once per Sweepstakes).
    • Comment on the Sponsor Sweepstakes Post on Instagram (this gets you one (1) entry and may only be utilized once per Sweepstakes) and tag up to five (5) different friends in your comment (each different friend tagged in your comment gets you one (1) additional entry).

On TikTok:

    • Like and repost the Sponsor Sweepstakes Post on TikTok and tag @montlicklaw (this gets you one (1) entry and may only be utilized once per Sweepstakes).
    • Comment on the Sponsor Sweepstakes Post on TikTok (this gets you one (1) entry and may only be utilized once per Sweepstakes) and tag up to five (5) different friends in your comment (each different friend tagged in your comment gets you one (1) additional entry).

Each Entrant is limited to a maximum of fourteen (14) entries per Sweepstakes. Entries are valid only for the respective Sweepstakes and do not roll over to subsequent Sweepstakes.

To be eligible for entry in a Sweepstakes, any comment on the Sponsor Sweepstakes Post must be responsive to the Sponsor Sweepstakes Post and must not include any content that would or could reasonably be deemed offensive, vulgar, discriminatory, harassing, or otherwise inappropriate, in Sponsor’s sole discretion.

Any attempt by an Entrant to obtain entries by using multiple/different identities, and/or any other unauthorized methods (such as bots or automated programs) will void that Entrant’s entries and that Entrant may be disqualified from the Sweepstakes. In the event of a dispute regarding the identity of an Entrant, the entry will be assigned to the authorized account holder of the social media account through which the entry was submitted (the “Authorized Account Holder”).

Neither Sponsor nor any Released Party is responsible for any entry that is lost, late, misdirected or undeliverable, whether due to your account settings, system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, not received due to any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.

The Promotions are not endorsed, sponsored, or administered by Instagram or TikTok, and each Entrant hereby releases each of those parties from any and all liability in connection herewith.

WINNING AND ODDS: Promptly following the close of each Sweepstakes Period, Sponsor will select one or more potential winner(s) (each, a “Potential Prize Winner”) for that Sweepstakes in a random drawing from amongst all eligible entries during the Sweepstakes Period as described above; the number of Potential Prize Winners will be disclosed with the Sponsor Sweepstakes Post. Odds of being selected as a Potential Prize Winner will depend upon the total number of eligible entries received for that Sweepstakes. The random drawing will be conducted under the supervision of a Sponsor representative whose decisions and interpretation of these Official Rules are final and binding in all respects.

NOTIFICATION: POTENTIAL PRIZE WINNERS WILL BE NOTIFIED BY DIRECT MESSAGE ON THE PLATFORM USED FOR THE WINNING ENTRY AND MUST RESPOND TO VERIFY ELIGIBILITY WITHIN TWENTY-FOUR (24) HOURS OF NOTIFICATION. Any Potential Prize Winner may be required by Sponsor to execute an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, “Prize Claim Documents“). If a notice is undeliverable or the Potential Prize Winner fails to respond and verify their eligibility or complete the Prize Claim Documents within the designated time period, that Potential Prize Winner forfeits his/her right to the Prize, Sponsor shall have no obligation to such individual, and such Prize will be awarded to an alternate Potential Prize Winner selected randomly from amongst the other eligible entries in a second drawing, so long as the alternate is verified no later than Noon (Eastern Time) the day before the event associated with the respective Prize. If no Potential Prize Winner can be selected and verified in a timely manner following the second drawing, that Prize will not be awarded. No Entrant is a winner unless and until their eligibility and compliance with these Official Rules are confirmed to Sponsor’s reasonable satisfaction.[

PRIZE/PRIZE CONDITIONS: Each Sweepstakes will have the number of prizes noted in the respective Sponsor Sweepstakes Post (each, a “Prize”), with each Prize consisting of two (2) tickets to either an Atlanta Falcons or an Atlanta United home game as described in the applicable Sponsor Sweepstakes Post, which will be transferred via the Ticketmaster platform from Sponsor to the verified winner(s). The total approximate retail value (“ARV”) of each Prize will be the face value of the applicable pair of tickets, which will range between $50-$350. No more than the number of Prizes indicated in the applicable Sponsor Sweepstakes Post will be awarded in each Sweepstakes. Use of the Prize will require compliance by the users with all terms and conditions established by the venue, team, and other administrators of the applicable event. Prize is limited to tickets only and excludes transportation, parking, food, merchandise, and any other benefit, all of which are the winner’s responsibility.

Each Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. No Prize substitution or cash redemption of Prizes. Sponsor will not replace any lost, mutilated or stolen Prizes. Sponsor reserves the right to substitute any Prize with a prize of comparable or greater value if Prize should become unavailable for any reason. Prize is not transferable, except that the winner may transfer one of the tickets to their companion that will be attending the applicable event with them. Prize winners are responsible for all federal, state and local taxes arising from receipt, possession, acceptance, or use of any Prize, if applicable. Limit of one (1) Prize per person/household across all Sweepstakes.

PUBLICITY AND PRIVACY: As a condition of accepting a Prize, each winner consents to Sponsor’s publication of his/her name as the winner. Sponsor may request that a winner (and the winner’s companion) grant additional rights to Sponsor to publish or distribute content related to such individuals and to document such individuals’ consent to such activity, which will be at such individuals’ discretion.

GENERAL CONDITIONS: Should any portion of the Promotions or any particular Sweepstakes be, in Sponsor’s sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotions and/or any particular Sweepstakes and/or to conduct a Sweepstakes in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of a Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false entry. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF A SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.

RELEASE: By participating in a Sweepstakes, Entrants agree to release and hold harmless each of the Released Parties, Meta (Instagram), and TikTok from and against any claim or cause of action arising out of participation in a Sweepstakes or receipt, redemption or use of any Prize to the fullest extent permitted by law.

LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (i) unauthorized human intervention in any part of the entry process or a Sweepstakes; (ii) electronic or human error which may occur in the administration of a Sweepstakes or the processing of entries; (iii) any injury, damage or loss (including death) to persons or property of any kind, which may be caused, directly or indirectly, in whole or in part, directly or indirectly from Entrant’s participation in a Sweepstakes or from the receipt, use or misuse of any Prize; (iv) any printing or typographical errors in any Sweepstakes-related materials; (v) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries; or (vi) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software.

DISPUTES: Entrants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Promotions, any Sweepstakes, or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by binding arbitration proceedings in accordance with and pursuant to the Commercial Arbitration Rules of the American Arbitration Association in the City of Atlanta, Dekalb County, Georgia. You recognize that your entry or any other participation in any Sweepstakes hereunder constitutes and serves as good and valuable consideration for your agreement to arbitrate any and all claims. You may only bring your claim(s) on an individual basis, and the arbitrator shall not otherwise preside over any form of a representative or class proceeding. You agree that final and binding arbitration shall be the sole and exclusive remedy for resolving any claims, instead of any court action, including the right to a trial by jury, which is hereby expressly waived. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, an Entrant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Promotions and/or any particular Sweepstakes, shall be governed by and construed in accordance with the laws of Georgia, without giving effect to any choice of law or conflict of law rules (whether of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Georgia.
