What to Expect
We want you to feel informed and involved in the process as we handle your case for you.
We would like to make this as easy for you as possible by answering some frequently asked questions upfront.
Below is an outline of the general legal procedures involved in handling your case. Please use this document as a general roadmap for what to expect as your case progresses.

This stage requires your active involvement. Here’s what you need to do:
Do not answer any questions or provide any information to other parties
- Do not discuss your case with anyone outside your immediate family.
- If you receive any calls from other parties including any insurance company (even your own) or from another attorney, refer them to our office.
- Let any friends or family who may answer the phone know that they too should avoid answering any questions or communications from other parties involved in this case.
Inform your lawyer of any witnesses
- We will attempt to acquire witness statements from individuals who have information about how the injury occurred.
- If you learn of any additional witnesses, please contact us immediately. If anyone calls you with information, please make sure to get that person’s name, phone number, and address before referring them to our office number.
Inform your lawyer of address changes
- If you will be out of town for any period of time, if you are moving, or if your contact information changes for any reason, call us and let us know where you can be reached.
Keep us in the loop
- Let us know about all medical appointments and any change in doctor/s or your medical condition.
- Keep all receipts for drugs or any type of medical equipment that you purchase.
- Send us copies of all medical bills you receive.
- If the hospital does not give you a copy of the bill, try to get the patient number which can be found on the identification bracelet.
- If you think of anything concerning your medical history or previous claims experience which we have not discussed, please let us know as these items are very important as the case progresses.
After your treatment has concluded, and we have received all related documentation, your attorney will carefully examine your case, medical costs, and all other damages associated to create a detailed settlement demand package. This stage generally does not begin until all medical treatment has been completed.
This stage involves:
- Your attorney sending pertinent information to the defendant.
- Your attorney will prepare and submit your Settlement Demand Package.
- After the other party has received your settlement demand, they will begin a final evaluation of your claim.
- Your attorney will begin Negotiation. This is critical because the insurance company’s priority is to pay you as little as possible, while our priority is to get you the maximum recovery possible. Your attorney will keep you informed of the negotiation process as it progresses.
This stage involves:
- Your attorney will file a Complaint, starting the lawsuit process. A Complaint is a formal legal document that establishes the basis and reason for the lawsuit and the listst the parties involved.You will be listed as the Plaintiff and the other party as the Defendant.
- Once your lawsuit is filed, it may or may not go to trial
- Should your case get to this stage, we will provide you with a more detailed summary of the entire process. Remember, you can always contact your legal team with any questions.
Your attorney will have primary responsibility for the day-to-day work on your case. Most of your questions and concerns should be answered by our regular progress reports and communication from your legal team. If you have any additional questions, feel free to contact your legal team at any time.
