GEORGIA – The website for the Georgia Governor’s Office of Highway Safety displays sections of Georgia law that apply to pedestrians. These laws include subjects like right-of-way considerations at crosswalks, crossing outside of crosswalks, and pedestrian traffic signals.*

According to Section 40-6-91 of Georgia Code, vehicle drivers are required to stop and wait for pedestrians to cross roadways inside of crosswalks if the pedestrians are on the side of the road where the vehicles are traveling and when pedestrians are approaching the lanes of travel of vehicles. Drivers cannot cut off, swerve around, or fail to stop for pedestrians.

In addition, according to the same section of law, pedestrians need to wait for oncoming traffic to pass before entering roadways in the state to cross. If a driver is close enough to the intersection that he or she could not practicably stop, the pedestrian needs to wait and remain on the curb.

According to Section 40-6-92, pedestrians need to cross roadways in crosswalks when they are available. Inside and outside of crosswalks, pedestrians need to yield to oncoming drivers, unless the drivers approached after the pedestrians were already in the roadway. Pedestrians should cross at intersections and only straight across intersections, not diagonally.

The term “jaywalking” is not part of Georgia’s legal code, but it is the most common way to describe pedestrians crossing outside of crosswalks, but it is an incredibly dangerous practice.

In the presence of traffic signals, according to Section 40-6-22, pedestrians have the right-of-way on “Walk” signals and must not enter the intersection on “Don’t Walk” signals. If the signal changes while a pedestrian is already in the road, the pedestrian needs to continue crossing, and drivers must stop.
