Who is Liable in an Amazon Truck Delivery Crash?

UNITED STATES – Automobile cases against Amazon's delivery network can be quite complex, according to Buzzfeed News and AUTOBLOG.com.  Over the past few years, Amazon has chosen at times to use independent delivery startup companies rather than FedEx, UPS and the United States Postal Service. If you are an Amazon Prime member, you likely enjoy free shipping on thousands of products, and also, the quick delivery turnaround that this membership offers.  In most circumstances, products arrive within two days, however, more and more products show up at Prime members’ doors within a day.

There have been recent news articles claiming that workers for these startup delivery companies experience a high-pressure, fast-paced work environment. One article claims that employees must deliver 250 packages a day, or sometimes even more. These articles further describe that these delivery companies' workers deal with relentless demands where they are often asked to skip meals, bathroom breaks, and rest times until their packages are delivered. 

According to an investigation by ProPublica and The New York Times, there have been at least 60 crashes were caused by independent delivery drivers that resulted in serious injuries over the past three years.   Ten of these accidents involved deaths.  It is believed that the amount of accidents is actually higher given that Amazon is not always included in accident reports or lawsuits. It is reported that Amazon drivers have crashed into vehicles, bikes, homes, people and pets.  

The investigation published by ProPublica and The New York Times, asserts that Amazon assumes little responsibility for accidents that occur as agreements are signed by the private companies and contractors who enter the non-stop delivery workflow. According to an Amazon operations manager interviewed for the investigation, "Delivery service partners” assume all liability and responsibility for legal costs including “all loss or damage to personal property or bodily harm including death."
