Plaintiff’s Witness Challenged by Johnson & Johnson in Asbestos Lawsuit

USA - reports that the attorneys representing the pharmaceutical giant Johnson & Johnson made attempts to undermine testimony given by the Plaintiff’s witness. The witness, a doctor, called to   that asbestos was detected at unacceptable levels in J&J’s talc powder, maintained his position in the fact of the critical questioning.*

The Plaintiff is a woman who has been diagnosed with mesothelioma. Mesothelioma is a type of severe and deadly cancer that is known to result from a person’s exposure to asbestos. Asbestos is a natural mineral which can be located in the ground. Talc, which also occurred naturally in deposits in the ground, is sometimes located in close proximity to asbestos. There is, therefore, a known risk of contamination in talc mined from places where asbestos is also located. 

The Plaintiff states that she used J&J’s talc-based product, Shower to Shower for about 40 years. She does not believe that she has been exposed to asbestos in any other context. 

The lawsuit is one of the thousands that has been filed across the country in response to the potential contamination of baby powder. Many of the cases claim that women who used the products on their genitals developed ovarian cancer. The cases involving mesothelioma are less numerous. 

The company has been facing scrutiny over the possible contamination, and some lawsuits have brought in internal company memos dating back decades which indicate trace amounts of the known carcinogen have been located in the company’s supply of talc. So far, the company has been hit with verdicts totaling in the billions as a result of juries finding that the product did create a risk and that the company knew of that risk and yet failed to warn its consumers. J&J continues to argue its talc products are completely safe.
