$2.5 million Kia Brain Injury Lawsuit Alleges Failure of Air Bags to Deploy Causing Injuries

UNITED STATES – According to an online news report at abc15.com, nearly every vehicle has safety features such as seat belts and air bags.  However, a recent class action lawsuit has been filed against seven automobile manufacturers due to air bags that did not deploy during an accident.

A 23-year-old woman was in an accident where her vehicle, a 2015 Kia Forte, failed to deploy its air bags, resulting in serious injuries.   The woman’s mother indicates that her daughter sustained a traumatic brain injury this past spring after she and her brother were involved in an accident where the air bags in her vehicle did not deploy.  

The National Highway Traffic Safety Administration (NHTSA) is currently conducting an investigation of approximately fifteen accidents where drivers indicate that their air bags did not deploy.  The failure to deploy stems from the air bag control unit, which is tasked with controlling the safety restraint systems in a vehicle.  "The Air Bag Control Unit (ACU) senses a vehicle crash to determine whether air bag deployment is required," per the NHTSA. 

The NHTSA has launched an investigation into certain models of vehicles, including those manufactured by Kia and Honda, following several reports of accidents where the air bags did not deploy.  Two accidents involved 2012 and 2013 model year Kia Fortes.  In 2018, there were a total of six crashes associated with defective air bag control units.

The family of the 23-year-old victim has filed a lawsuit against Kia for $2.5 million for not issuing a recall of the 2015 Kia Forte.  The family’s attorney has also filed a class action lawsuit against seven vehicle manufacturers due to having “concealed a deadly air bag defect in 12.3 million U.S. cars.”
