Vape Manufacturer, Juul, Accused of Deceptive Marketing Practices

UNITED STATES – According to an online article at, the United States Food and Drug Administration (FDA) accused Juul of engaging in deceptive marketing practices due to advertising that its vaping products are safer than regular cigarettes.*

An official warning letter was issued to the CEO of Juul, which gave the company a fifteen-day deadline to submit a plan to address its violations of federal law.  A second letter requested additional documentation related to a congressional hearing as to whether Juul was targeting schools and youth camps.

The commissioner of the FDA indicates that the industry has been put on notice regarding its efforts to target youth in advertising.   “If the disturbing rise in youth e-cigarette use continues, especially through the use of flavors that appeal to kids, we’ll take even more aggressive action,” the FDA commissioner noted.  

According to the FDA, Juul has been marketing its products as being less risky than conventional cigarettes.  In fact, the company has indicated publicly that its products are modified risk tobacco products. However, they are designated as regular tobacco products, which carry the same risks as cigarettes.  When Juul was reached for comment, they indicated that they will fully cooperate with the FDA.  

The FDA letter issued to Juul references testimony provided in a congressional hearing that occurred this past July, implying that Juul was targeting children in their advertisements.  Specifically, Juul indicated that its products were safe. According to witnesses, Juul spoke to students, informing them that their products are “totally safe” and “99% safer than cigarettes.”  Both of these claims were made during an assembly at a school after teachers left the room.
