Deadly Tesla Model S Crash Leads to Lawsuit against the Manufacturer

October 24, 2019

FORT LAUDERDALE, FL-  A tragic crash involving a Tesla Model S has led to a lawsuit filed by the victim’s parents against the vehicle manufacturer, according to Carcomplaints.com. The crash killed the driver, an eighteen-year-old boy, and another passenger as well.*

The victim’s parents stated in their claim against Tesla that they contacted the manufacturer in March of 2018 to have a speed limiter installed in the vehicle after their son was ticketed for driving the Model S 112 in a 50 mile per hour zone. The company stated that they had installed a limiter that prevented the vehicle from traveling above 85 miles per hour.

The vehicle was later serviced, and the son allegedly had the company remove the speed limiter without the permission of his parents who owned the vehicle.

The son later crashed the vehicle after losing control at a high rate of speed, driving approximately 116 miles per hour before the crash according to an investigation conducted by the National Transportation Safety Board (NTSB).  The parents claim their son should have survived the crash, as he had his seatbelt on and the airbags deployed, but the battery negligently caught fire, and the fire was allegedly the cause of death.

The victim's parents are claiming that Tesla was aware of the risks presented by its lithium-ion batteries, which can cause "thermal runaway," leading to severe fires that can allegedly take up to 24 hours to extinguish. The lawsuit also claims that the door handles did not extend, preventing emergency responders from being able to rescue the two trapped teens.

A third eighteen-year-old boy who was in the back seat of the vehicle managed to survive the fiery crash. He was reportedly ejected from the vehicle.
