Georgia Couple Files Lawsuit Against Carnival Cruise Line for Tilting Incident

January 25, 2019

GEORGIA – A couple from Georgia has filed a lawsuit against Carnival Cruise Lines over injuries sustained during a tilting incident, according to an online news story published at foxnews.com. The incident occurred shortly after departure of Carnival ship from Florida in October 2018.*

On October 28, 2018, Charles and Susan Orgbon, of Georgia, were aboard a Carnival Sunshine cruise ship that had departed from Port Canaveral, Florida. A few hours after leaving, the ship listed (leaned) strongly to one side. The Orgbons were inside the ship’s restaurant at the time, and according to their lawsuit, the incident threw Susan Orgbon from her chair.

Susan Orgbon allegedly suffered a spinal injury during the event, and Charles Orgbon suffered a wrist injury while trying to help his wife. A third passenger who joined in the lawsuit, Alveta Jordan Armstrong, of North Carolina, was also in the restaurant when the ship listed and claims she suffered a wrist injury.

Carnival reported after the incident that the tilting had been caused by a malfunction with one of the ship’s fin stabilizers. The fin stabilizers are supposed to prevent the ship from rolling from side to side in the water, but one of them experienced an issue and failed to prevent the ship from tilting. The result was reportedly chaos, as dishes and chairs went flying, and passengers became frightened.

The ship quickly returned upright, and the cruise continued as planned, according to a statement from Carnival. In this statement, Carnival apologized to guests for the “disruption” and said, “We remain confident of the safety of the ship as we are committed to the safety of our guests and crew.”
