Jury Finds Grocery Store and Employee Responsible for Death of Woman in Parking Lot Accident
Many parking lot accidents involve fender benders or grazing the side of another car when pulling in or backing out of a parking spot, among other minor collisions. Nobody expects to see a catastrophic car accident occur in any parking lot, but that's exactly what happened nearly four years ago in Gretna, Louisiana shortly before Thanksgiving. A recent $1.4 million trial verdict found that a grocery store itself, as well as the store's employee, were responsible for the tragic death of an 85-year-old woman in 2012.
The woman needed assistance backing out of a tight parking space, and enlisted the help of a grocery store employee. As the employee backed the woman's car out of the parking spot, he did so with the driver's door open. The open door slammed into the woman and knocked her down. The vehicle subsequently rolled over the woman both in reverse and moving forward, essentially crushing her body. As a result of this parking lot accident involving only the woman's vehicle, the woman suffered multiple broken bones and had skin sheared off of her body. She initially survived the accident for one month after undergoing extensive surgeries, but then tragically passed away.
The woman's family later brought a lawsuit claiming both the grocery store and the employee driving the woman's vehicle were at fault for causing the accident that led to the woman's death one month later. However, the family doesn't believe the jury's award was significant enough to account for the horrific injuries the woman suffered from that required painful procedures, and will seek to recover additional compensation for the woman's wrongful death.
The Complicated Nature of Parking Lot Accident Cases
While a parking lot accident may seem as though it should not be treated any differently than any other car accident, the situation can become more complicated when the parking lot is owned by a business and/or an employee of the business is involved in the accident in some way. If you have been involved in a parking lot accident caused by negligence, or have lost a loved one as a result of such an accident, you should seek the advice of a legal professional at Montlick and Associates right away. Do not delay in seeking legal assistance, as you have a limited amount of time to pursue a claim.
