Pedestrian Accident Claims Life of Atlanta Woman

June 15, 2016

Recently, an Atlanta woman was tragically killed while standing at a bus stop. The 21-year-old accident victim was struck by a Toyota pickup truck while waiting for the bus. She was pregnant at the time of the accident and headed to pick up her cap and gown for graduation. Sadly, the accident appears to have been the result of a medical emergency. The driver of the vehicle involved lost control of the car, hit another vehicle, then careened into the pedestrian. When police arrived at the scene, the driver was disoriented and foaming at the mouth. Now, family members of the young woman are left mourning her death and that of her unborn child.

This recent accident deeply saddened our pedestrian accident attorneys at Montlick and Associates, Attorneys at Law. This is the most recent in a number of pedestrian accidents to occur in the Atlanta area in recent years. We understand that pedestrian accidents are some of the most serious accidents that can occur due to the force of vehicles striking a person directly.  Thus, we assist injured pedestrian accident victims and the families of those who lose their loved ones in such accidents in obtaining compensation from the at-fault person(s) or company(s) involved.

Wrongful Death Pedestrian Accident Cases

A pedestrian accident that results from negligence on the part of the driver can constitute grounds for a wrongful death pedestrian accident case. The parties bringing the action will need to establish that the driver acted with negligence, which could include many types of behaviors, such as speeding, drinking and driving, distracted driving, and much more.

Georgia law allows the surviving spouse or surviving children to bring an action for wrongful death. Any recovery obtained will be split among the children and the surviving spouse, with the surviving spouse receiving no less than one-third of the recovery, regardless of the number of children. Possible damages in a wrongful death case include, loss of income and other benefits, companionship, support, and more.
