Home and Property Damage After a Car Accident
If the driver of an automobile negligently hits your house, that person can be liable for any and all damages. However, the insurance company will only pay up to the policy limits for the particular coverage involved. For instance, if a negligent driver slammed into your home and caused $100,000 worth of damage to your home, you could face complexities if the driver's policy offers just $25,000 in property damage. The insurance company is liable only up to the maximum policy limits. Amounts in excess of this figure will not be collectable from the insurance company under ordinary circumstances.
So how do you obtain compensation for the remainder? In the case of a house being damaged, you have a few other options. You could seek to file a homeowners' insurance claim. Most homeowners' insurance policies will cover against damage caused by the negligence of third parties, although your specific policy could vary. You might also be able to seek compensation through your insurance company, even though you were not the one driving, at times your comprehensive coverage will handle an accident such as this, depending on your policy. Although low policy limits on the part of the driver will complicate the action, you still have several viable options to recover for your damages from the accident.
Whenever you have experienced injuries or considerable property damage in an accident, you will need the assistance of an experienced car accident attorney.
