Atlanta Hit and Run Driver Kills Pedestrian on Sidewalk

August 14, 2015

Police are searching for the individual responsible for a fatal hit and run accident that occurred in Atlanta on July 19, according to WSB TV. The victim was walking down Cleveland Avenue on the sidewalk, when suddenly a car went across all four lanes and pummeled into him on the sidewalk. The car jumped the curb and ended up in the parking lot of a store. Police report that a call came in at about 1:15 a.m. Sunday. A witness reports seeing the car hit the pedestrian, jump out of the vehicle, and run away into the woods.

For the family of the deceased pedestrian, nothing can bring their loved one back, but finding the person responsible can help bring closure and justice.

Consequences of a Hit and Run Accident

A hit and run accident is defined as being involved in a car accident with either a pedestrian, another car, truck, or fixed object, and then leaving the scene of the accident without stopping to identify yourself, render aid, or exchange insurance information. It does not matter whether the person caused the accident or not; all drivers are required to remain at the scene of the accident and identify themselves or render aid to injured parties.

Georgia imposes criminal penalties for committing a hit and run. Perpetrators can face monetary fines of up to $1,000 and imprisonment may occur. Leaving the scene of any accident that resulted in serious injuries or death will be a felony charge.

The victims of a hit and run collision can pursue civil action against the at fault party, seeking damages for all injuries suffered as a result of the accident or wrongful death damages in the event of a fatality. Accident victims should be able to seek increased damages against the party responsible for the crash if they fled the scene of the accident, with some courts allowing treble or three times the damage award.

Hit and run accident victims can also face some challenges in bringing the wrongdoer to justice. It will first be necessary to identify the at fault driver and then pursue action. The local police and your attorney will assist in resolving your hit and run accident case.
