McDonalds Happy Meal Toy Recalled Because It Poses a Choking Hazard

December 18, 2014

McDonalds and other fast food chains have come under fire for the inducements they use to encourage kids to eat food that might not be the healthiest choice.  Happy Meal toys are one of the most enticing lures for kids.  However, a new concern about McDonalds Happy Meal toys has nothing to do with nutrition.  The toy, which was included in Happy Meals sold from October to November 2014, has been determined to be a choking hazard.

A recall has been announced for the “Hello Kitty Birthday Lollipop” whistle which poses a choking hazard for young children because the whistle can be removed from the Hello Kitty figure.  While the whistle is designed for kids to blow into it, parts of the whistle can be inhaled causing a child to choke.  McDonalds has reportedly received a report of a child needing medical treatment after choking on a part of the whistle.  An additional report indicated that a child coughed up a part of the whistle that he inadvertently inhaled.

Although product recalls covering children’s toys like this one are designed to protect the public, people often suffer injury if they obtain the defective product prior to the recall, or they are unaware of the recall.  When consumers are injured by an unsafe product, they should seek prompt medical attention.  Depending on the nature of the injury, medical bills can rapidly reach a level that they are not manageable.  Customers injured by faulty products also might suffer a broad range of other damages that include pain and suffering, lost wages, diminished enjoyment of life just to name a few examples.

When a hazardous product causes injury to a consumer, any entity in the production or distribution chain can be liable for resulting injuries, such as the manufacturer, wholesaler or retailer.  Product liability claims may be based on several theories of liability including breach of warranty, strict liability and negligence.  Contact our defective products injury attorneys at Montlick and Associates for a free consultation about your legal rights.
