Parents File Lawsuit After Son is Killed by Brain-Eating Amoeba in Arlington, Texas

October 07, 2021

ARLINGTON, TEXAS - Parents of a three-year-old boy filed a wrongful death lawsuit against the City of Arlington in Tarrant County District Court in Fort Worth, Texas.  The lawsuit alleges that their son was tragcially killed after he played on a splash pad that was contaminated with a rare brain-eating amoeba.  The lawsuit alleges the city was negligent because they failed to adequately operate and maintain the splash pad.

The parents' son tragically passed away on September 11 after he was hospitalized with primary amebic meningoencephalitis.  Primary amebic meningoencephalitisa is a rare and usually deadly infection caused by the naegleria fowleri amoeba.

The Centers for Disease Control and Prevention discovered the brain-eating amoeba in water samples that they collected from the splash pad the victim had visited.  One city official stated that he discovered gaps in park's daily inspection program and this caused maintenance standards not being met.

The family's lawsuit allege city employees "failed to adequately monitor and chlorinate the city's splash pad water, making the splash pad unreasonably dangerous."

According to the news article, the victim's mother stated that her son visited the splash pad at Don Misenhimer Park, and her son quickly developed a fever that measured 102 degrees.  Her son also felt weak and he would not drink or eat.

All of the Arlington's four splash pads were shut down for the rest of the year.

The CDC stated that naegleria fowleri infections are very rare, with only 34 infections reported in the United States from 2010 to 2019.  The article says that infection is usually caused by contaminated water entering in through the nasal passages when people are diving or swimming in rivers or lakes.
