Mediation a Viable Approach for Georgia Personal Injury Claims

The process of mediation is becoming more popular as a method for resolving personal injury cases. The cost of litigation is rising and court resources sometimes lead to delays because criminal cases take precedence over civil lawsuits.

Mediation is a form of alternate dispute resolution that can be used to reach a settlement in a wide range of personal injury cases including:

A mediation is basically an informal proceeding where a neutral third party, who may be an ex-judge or someone else approved by both sides, listens to arguments from both sides. Typically, the mediator will conference with both the plaintiff and the defendant individually in a confidential meeting and listen to each side's position. The mediator will discuss each party's position with them including the strengths and weaknesses of their respective cases to suggest potential settlement proposals. The parties can voluntarily agree to settle the case but the decision of a mediator is nothing more than a non-binding recommendation. The proceeding is conducted in a totally confidential manner. No notes or records of the process are admissible for any later purpose. If we are not able to reach a settlement that we think is fair for our client, we will continue litigation of the case including proceeding to trial.
