Truck Involved in Fatal Georgia Accident Owned by Company with Safety Issues
We recently reported on a tragic accident in Cartersville that claimed the life of a 30 year old mother of two. A local family was on their way home when a runaway tractor trailer pummeled into their car. The 30 year old mother, wife, and missionary was tragically killed instantly in the accident. The husband and two young children were injured.
Investigators have worked tirelessly to uncover the cause of this horrific accident and have discovered that the truck rolled away while parked near a chemical plant. Initial investigations revealed that the driver either failed to put on the parking brake or the parking brake did not function correctly. Now, police have uncovered more information that paints a better picture as to the cause of the accident, according to WSB TV. We now know that the truck is owned by Celadon Trucking Services. This company operates out of Indiana and employs more than 2,800 drivers. The driver did not, in fact, set the parking brake when he exited the vehicle to conduct a pre-trip inspection.
Celadon Trucking has a spotty safety record. According to United States Department of Transportation records, the company has been flagged for unsafe driving over 700 times in the past two years and has received more than 1,500 maintenance violations. The truck driver faces a host of criminal charges, including DUI. In fact, police report that he was under the influence of prescription medications at the time of the accident. Celadon drivers have received at least 10 violations for drug and alcohol use in the past two years. These facts indicate that the trucking company should be held accountable for the negligent actions of its driver in claiming the lives of the victim and injuring the rest of the family.
Checking a Motor Carrier's Safety Record
If you have been injured in a truck accident, it is imperative that you check the safety record of the motor carrier or trucking company involved as soon as possible. Several federal databases hold vital information as to instances of unsafe driving, vehicle maintenance violations, driver fitness, hours of service compliance, hazardous materials compliance and crash history.
A questionable safety record can indicate negligence on the part of the trucking company. For instance, a trucking company with several vehicle maintenance violations could face serious consequences if someone is injured by a member of their fleet due to a maintenance related issue. The trucking company is responsible for training, supervising and ensuring the safety of its drivers and trucks. If the company fails to live up to its duty, it can be held accountable for accidents that result.
