Atlanta Bus Accident Case Settles for $940,000

The driver of a Party Bus made a right turn from the Reserve at Ivy Creek Apts. The driver realized that he had made a wrong turn and began looking for a place to turn around. After driving for ¼ mile the driver found an opening in the median and performed a u-turn. While negotiating the turn, the driver misjudged the turning radius of the bus and was forced to stop. The driver then backed up into our client.

Our client had just turned out of the same apt complex when the bus backed into her. The bus had a generator on the back which extended out 3 ½ feet. The generator made impact with her vehicle and she was killed at the scene. She was survived by her mother who is on a fixed income, along with the victim’s 4 year old son. Our client's mother is formally going through the process to obtain temporary guardianship of her grandchild and filing for benefits such as Social Security and food stamps to help with supporting the child who lost his Mom.

Based on several of the bus passengers' statements, the bus was backing up at the time of impact. According to one passenger, the driver never even looked prior to backing up. The bus driver was at fault for Vehicular Homicide 2nd degree, Improper backing (interfering with traffic) and operating unsafe commercial vehicle.
