(SARAH)Florida “At fault” Insurance Mandate Stalled in Florida's Congress

March 21, 2020

ORLANDO, FL- writes that Florida legislators have not finalized a decision on mandating that drivers carry “at fault” insurance. The current session is coming to an end, and the future of the legislative changes remains unsettled.*

Florida’s law is currently different from most states because it does not require that drivers maintain policies that have minimum liability coverage. The issue of car insurance in Florida will remain complicated even if the lessgislature passes the law as many Floridians are driving with the requisite no-fault “personal injury. Current estimates indicate that about one out of every four motorists in the state does not have any car insurance.

One woman described the unfortunate experience of being involved in a severe crash with an uninsured driver. The mother was traveling in the car with her child when a 20-year-old motorist ran through a stop sign and struck the side of her vehicle. Following the impact, the woman stated that she could not feel her legs or move them to exit the car. While the injury will require surgery to treat, the woman found out that the young driver who caused the wreck did not have any car insurance.

Florida has one of the highest rate of uninsured drivers in the nation. Even out of the drivers who do maintain insurance, about 40 percent only carry the minimum coverage required, which does not include any protection for other drivers.

The passing of the law will still only provide that drivers must carry minimum coverage of $25,000 per individual injured in a crash. As a result, people with severe injuries would not have their treatment covered even with the new law.
