There are several causes of pedestrian accidents that are associated with a driver who is at fault.

Customarily, pedestrian-automobile accidents relate to the duty of care owed by drivers.  It is critical that pedestrians and drivers alike follow all road rules and exercise reasonable care.  In many pedestrian accidents, it is obvious who was negligent.  However, the courts examine a number of factors in applying the acts to the elements of negligence.

Drivers must exercise reasonable care when behind the wheel. This includes a duty to operate one’s vehicle in safe manner so as to avoid accidents. The most common factors that contribute to driver negligence include the following:

  • Driving while distracted
  • Driving in excess of the speed limit
  • Not yielding to the right of way to pedestrians located in a crosswalk
  • Not following traffic signals and signs
  • Failing to use one’s turn signal to communicate to pedestrians and drivers alike as to one’ intended direction
  • Driving while impaired by drugs and/or alcohol
  • Failing to drive in a safe manner during periods of inclement weather
