What is the Danger of Phillips Respironics CPAP, BiPAP, and Ventilator Machines?

As a result of Philips manufacturing the devices with toxic sound abatement foam, many CPAP users have been unknowingly breathing and swallowing carcinogenic foam particles for several years. The foam has been linked to several different forms of cancer and other severe health problems, particularly with long term exposure. The recalled CPAP, BiPAP, and ventilators have been on the market since 2009, and have been used by millions of Americans since 2012. 

The Dutch medical firm Phillips, who is the largest producer of these machines in the U.S., recalled millions of devices in 2021 over concerns that the machines put users at a heightened risk for cancer, respiratory issues, inflammation, nausea, and vomiting. In a media release, Phillips admitted that the CPAP and ventilator devices can degrade, and release potentially toxic particles and fumes which can be swallowed or breathed in by users of the breathing machines.

What are the symptoms of CPAP poisoning?

In addition to reports of cancer, users who used the recalled Phillips machines also experienced the following symptoms: headaches, upper-respiratory problems, asthma, vomiting, sinus infections, sinus pressure, coughing, kidney and liver damage, and breathing problems. 

When used, the defective devices omit a polyurethane sound abatement foam, which is toxic to patients and can result in the following symptoms:

  • Asthma

The Philips Respironics CPAP Class Action Lawsuit

Even though there were reports that Philips knew about the problems caused by the toxic sound abatement foam for several years, the company did not issue a public warning until April 2021. In June 2021, a class action was filed to hold Philips responsible for illnesses and injuries connected with toxic foam used in association with their breathing machines. 

In June 2021, the FDA issued a Class 1 recall on the affected Philips breathing machines. A Class 1 Recall is the most severe class of recall and is applied to products that cause injury or death. Interestingly, this coincided with the release of the newer model of machine, which was approved for market use. Many patients who relied heavily on the machine were forced to purchase the new one, meaning Phillips continued to make a profit despite the serious flaws with their machine. 

The Philips CPAP lawsuits are broken down into two separate allegations: (1) Philips Respironics failed to adequately warn of the risks of their product, and (2) The design of their product was defective, and therefore inherently dangerous. 

But what does this mean? Let’s break it down. 

  1. Failure to Warn - The company, Phillips, who manufactured and distributed the machine, was aware of the risks and cancer-causing foam yet failed to warn consumers. There were allegations that consumers had issued complaints of the issues associated with the machines for years before a recall was issued. Even more despicable, the company continued to produce the machine for two months after they issued a public warning in April 2021. The company was wantonly negligent in their failure to properly warn consumers of the cancer-causing risks and MUST be held accountable.
  2. Defective Design of the CPAP Machine The defective design of the CPAP machine renders it an inherently dangerous product because of the machines toxic foam, that should not have been on the market in the first place. The FDA has recorded over 1,200 complaints and counting since the Phillips CPAP recall in 2021.
