Florida Considering Elimination of No-Fault Law for Auto Accidents
FLORIDA – According to an online news story published at watchdog.org, Florida is considering elimination of its no-fault law relating to automobile accidents in the state. Currently, the law requires all drivers in Florida to carry certain insurance that will compensate them in the event of a car accident.*
Florida passed its no-fault law in the late 1970s, and it is one of a minority of states in the U.S. that still has such a law. The law mandates drivers carry personal injury protection (PIP) insurance with $10,000 for medical coverage. In the event of a car accident in the state, injured drivers must submit claims through their own PIP insurance, regardless of who caused the accident.
The law was passed with the intent of delivering expedient payouts to accident victims and to prevent the courts from being overwhelmed with car accident cases. However, in the last several years, litigation has continued to increase, and PIP insurance claims are the subject of countless fraud investigations.
The bipartisan bill SB 1052 to eliminate the no-fault law is now moving through hurdles in Florida. It was introduced by Sen. Tom Lee (R-Thonotosassa) and Sen. Darryl Rouson (D-St. Petersburg). It recently passed in the Senate Baking and Insurance Committee and will now move into the Senate Appropriations Committee. If it passes this hurdle, SB 1052 will proceed to the Senate floor.
If it became law, the bill would require Florida drivers to carry policies with $25,000 coverage for bodily injury, $50,000 coverage for two or more persons injured, and $10,000 coverage for property damage.
