City of Tempe, Arizona, Facing Lawsuit Over Deadly Uber Crash
TEMPE, AZ. – According to a news report published online at thedrive.com, the City of Tempe, Arizona, is facing a lawsuit over a deadly Uber crash that occurred last year. A 49-year-old woman was killed in the accident by an autonomous Uber vehicle, and the woman’s family plans to sue the City.
The accident occurred in March 2018, when the woman was walking with her bicycle near Mill Avenue in Tempe. She was using a brick walkway that ends at Mill Avenue, south of Curry Road. There is no crosswalk along Mill Avenue at the point where the walkway ends. When the woman came to the street, she crossed at the point where the walkway ends.
As she was crossing the street, an autonomous Uber vehicle hit her. She did not survive. Investigation of the accident revealed that the human safety driver inside the Uber was watching a television program on her cell phone and was not looking at the road before the collision took place. Additionally, the automatic braking system in the Uber vehicle was not enabled. Uber has already settled a claim with the victim’s family for a confidential sum.
The daughter and husband of the victim are now also planning to file a lawsuit against the City of Tempe under wrongful death law. The suit will seek $10 million in damages — $5 million for each of the two plaintiffs — and alleges that the city’s brick walkway and lack of crosswalk created a dangerous situation for pedestrians.
The claim states that the location of the ending point for the walkway encouraged pedestrians to cross Mill Avenue outside of a crosswalk, placing them at risk of harm from oncoming traffic. The City of Tempe stated that it could not comment on pending litigation.
