Victims File Lawsuits Following Tragic Chattanooga School Bus Accident

January 26, 2017

It has been a tragic year for many Americans, and the Chattanooga School Bus Accident is no exception. As families and friends are still mourning, victims of the school bus accident have sought legal action to recover damages for the suffering the injured and deceased victims have gone through.

An initial group of lawsuits was filed by families on behalf of severely injured victims who survived the accident. According to a local news report, since the filing of these lawsuits, another lawsuit has been filed on behalf of a 10-year-old girl who suffered fatal injuries as a result of the Chattanooga School Bus Accident. All of these lawsuits for personal injuries have been filed against the owners and operators of the school bus as well as the school bus driver himself. However, the family of the deceased 10-year-old girl also named the manufacturer of the school bus's windows as a defendant, alleging that these windows were defective and contributed to the girl's fatal injuries.

Deceased 10-Year-Old Girl's Lawsuit Seeks Millions in Damages

The lawsuit filed on behalf of the deceased 10-year-old girl asks for $5 million in compensatory damages (which would include pain and suffering), and $500,000 in punitive damages, which are damages that are intended to punish and deter similar reckless and negligent conduct in the future. Damages are intended to make a plaintiff as "whole" as possible, and while one's life cannot be brought back, compensation through a lawsuit is usually the most feasible way for an injured victim to recover after suffering severe or fatal injuries.

More Lawsuits May Follow

Given that it is pretty clear something went very wrong to cause the horrific Chattanooga School Bus Accident, it is likely that more lawsuits will be filed on behalf of injured and deceased victims who suffered through no fault of their own. It is important to keep in mind that any time a lawsuit is filed, it could take months if not years to make much progress.

There are multiple factors that contribute to how long the legal process will be for a particular case. With regard to the Chattanooga School Bus Accident, there are many parties involved so if these cases do go to trial, it could be two or more years before a jury hears the cases. On the other hand, if the parties agree to settle the claims sooner, the matter may be resolved much more quickly, and a trial would not be necessary. All cases are different based on the facts and severity of injuries, and the victims of the Chattanooga School Bus Accident hope to recover what they deserve for the suffering they have gone through.
