Gwinnett County School Bus Involved in Crash

December 01, 2010

We have previously written on this blog about the wave of Atlanta area school bus crashes that have occurred over the last couple of months, including one crash that led to the tragic death of a child. Unfortunately, it appears that the disturbing trend continues as a Gwinnett County school bus was struck by a passenger vehicle driven by a pregnant woman at an intersection last Friday. Preliminary reports indicate that the pregnancy was not affected, but several school children had to be taken to the hospital for treatment of their injuries.

While school bus accidents can be the fault of a poorly trained or careless bus driver, a school bus can be involved in a car wreck even when the driver does everything correctly. The other driver in the Gwinnett County crash drove her vehicle into oncoming traffic. At Montlick and Associates, we have been helping those who suffer injuries or death in bus accidents throughout the Atlanta area and the entire state of Georgia for over 39 years.

The Gwinnett County school bus accident is a sad reminder that our children are not necessarily safe when we place them on the bus for school. Four school bus crashes in the greater Atlanta area over the last few months also serves as a warning that a school bus crash is not an isolated or unlikely event. There can be many causes for such crashes including a failure to properly train or supervise a bus driver. However, there are often other parties responsible for injuries children suffer in school bus crashes including drivers of other vehicles, a government entity for defective roadway construction, or companies that manufacture or maintain the bus. Litigation involving injuries suffered in a school bus crash are complicated because there may be multiple parties and causes that contribute to the accident. These challenges are even more significant because a government entity, such as the school district, is often a defendant. Special rules and procedures apply when suing a government entity, which mean shorter time limits to pursue one's claim and more administrative obstacles.
