Uber Tries to Manipulate an Injury Claimant Into Giving Up Her Legal Right to a Trial By Jury 

According to a news story published on Patch.com, an accident injury victim filed a personal injury lawsuit against Uber, and Uber revised its terms of use "retroactively" to force accident claimants into arbitration.

The plaintiff purportedly received an email from Uber containing new terms and conditions. The plaintiff then clicked a link that accepted the new terms and conditions without comprehending that she would be giving up her constitutional right to a jury trial.  

Uber's defense attorneys then tried to have the court dismiss the accident injury victim's case, although the Plaintiff unknowingly accepted Uber's new terms of use revised to limit the accident victim's legal rights to recover financial compensation through the legal system. Uber's new terms of use policy also stated that Uber customers agree to "retroactively" waive their rights to a jury trial and consent to arbitration when injured in an Uber accident. The Plaintiff stated that she was horrified to later discover that Uber was attempting to use a "retroactive clause" to prevent her from filing her personal injury lawsuit and stop her from demanding a jury trial to obtain compensation for her Uber-related accident with injuries.

The Plaintiff, a college student, filed a personal injury lawsuit against Uber after she was severely injured in an accident caused by her Uber driver, who refused to drop her off at a safe location. The Plaintiff's attorneys argued that she asked the Uber driver to drop her off at a specific location because it was safe. The lawsuit alleges that the Uber driver dropped her off at a dangerous intersection, causing her to be hit by another vehicle. She sustained very serious injuries as a result. The Plaintiff stated that after she woke up after the collision, she had blood running out of her mouth and had lost a lot of teeth. She also sustained several serious injuries, underwent reconstructive surgery, and needed dental implants implanted inside her mouth.

The accident victim said that Uber drivers should pick up and drop off their customers at secure locations away from traffic to prevent injuries.
