Does Med Pay Stack in Georgia?

"Stack" is a legal term of art.  Stacking refers to any situation in which multiple coverages add together when the insured person has those coverages.  Insurance Stacking does not include insurance coverages "in addition" to what is covering the defendant's vehicle.  Stacking Insurance coverages pertains to the claimant's motor vehicle insurance coverages.  For example, an individual may have a State Farm insurance policy on one car and another policy with Progressive on another vehicle.  If the claimant has the same types of coverage on those two policies, our attorneys would want to argue for the claimant that their two insurance policies "stack."  

With regards to stacking Med Pay, the first question is, "Was there Med Pay on the motor vehicle that you were riding in at the time of the accident?"  If the claimant has Med Pay, then it might be possible to get the Med Pay to stack assuming that the claimant can prove that they have the medical bills to get it.  Also, the claimant would have to "max out" the first coverage before the claimant could apply for the other policies.  So, for instance, if you have $5,000 in Med Pay coverage on your car and you have a friend riding in your car with you, and suddenly your car is rear-ended.  Your friend would receive money from your Med Pay coverage, and then he or she could file to receive a Med Pay payment from their Med Pay policy as long as there are enough medical expenses to necessitate the Med Pay payouts.  The Med Pay coverage stacking can be applied in several different circumstances.  However, Med Pay is typically written to cover the occupants inside one specific motor vehicle.
