How Does Med Pay Work in Georgia?

Under Georgia Law Section 33-34-2(1), medical payments (MedPay) coverage, is an optional type of auto accident insurance no-fault coverage offered by Georgia insurance carriers.  This means regardless of how the incident transpired, whether you or someone else is at fault for the accident and you have medical bills, you can claim Med Pay coverage for those medical bills up to the extent of the amount of coverage.  MedPay limits may range as low as $1,000 or up to $50,000.00 to the insured.  

One major benefit of MedPay is that when you have the coverage, in the event of an accident involving multiple passengers, every passenger riding in the car is also covered.  So, if you purchased $5,000 in Med Pay on a motor vehicle, and there are three people in the vehicle at the time of an accident, each person would receive $5,000 to pay accident-related medical expenses.  In order to recover MedPay funds, you must  submit accident-related medical expenses to the MedPay insurance carrier.   

Most insurance policies provide that MedPay is only available for the insured if they are within the covered vehicle at the time of the incident. For example, if a person covers their own vehicles with MedPay, but is involved in a motor vehicle accident while in someone else's car, such as a taxi or Uber, depending on the way the policy is written, coverage may be denied in such instances.  It is important to understand your insurance policies and calling your insurance agent is a good way to do so.
