Alabama Legislature is Considering a New Bill Banning Handheld Cell Phone Use While Driving

March 02, 2021

MOBILE, AL - The Alabama legislature is considering a new bill that bans handheld cell phone use while driving.  Alabama lawmakers are trying to take more action against distracted driving, particularly cell phone use when driving.  Alabama's current distracted driving laws do not permit drivers to send or read text messages when driving.  The new bill, H.B. 90, would improve the current law.

Mobile Police states that anything that can be done to stop distracted driving must be considered.  The officers stated that they witness many drivers using their phones while driving, which lead to a lot of accidents.

If passed, H.B. 90 would make it a crime to hold your phone while driving in the state of Alabama.  H.B. 90 would also prohibit viewing, recording, watching, or capturing photos or videos.  The proposed legislation would also ban calling someone and talking on a cell phone without a hands-free option when driving.

Mobile Police Corporal Ryan Blakely stated that a driver engaging in driving and texting is 23 times more predisposed to an accident than a driver who is not driving while texting.  Corporal Ryan Blakely also stated that distracted drivers cause many accidents.

H.B. 90, if enacted, grants law enforcement the authority to fine a first-time offender $100, $200 for the second offense, and $300 for the third and subsequent offense. Twenty-five other states now have some type of handheld cell phone while driving ban.
