Tragic School Bus Accident Results in Death of Carroll County Student

October 19, 2010

A tragic school bus accident killed one Carroll County student and injured 10 others last week. The bus driver apparently lost control of the vehicle, and the school bus left the roadway ending up in a ditch before overturning. The Georgia State Patrol reported that the bus crashed on Highway 113 near Hog Liver Road between Carrollton and Temple, near I-20.

According to news media reports, the bus flipped causing several students to be ejected from it. Everyday we entrust our children to the safety of school officials and school bus drivers when we put them on the bus and send them off to school. This tragedy serves as a somber reminder that our children can be injured despite our best efforts to keep them safe. At Montlick and Associates, Attorneys as Law, we have been representing automobile and bus accident victims throughout the State of Georgia for over 39 years.

At this stage, it is still unclear why the bus driver lost control of the vehicle causing the vehicle to leave the roadway and overturn. A single vehicle bus accident where the bus leaves the roadway can sometimes be the result of mechanical failure or driver error. In a bus accident of this type, the school district may have liability. There also may be third parties that contributed to the accident if the vehicle experienced some sort of mechanical failure. In such a situation, the company that serviced or manufactured the vehicle, as well as a company that supplied any defective parts, may also be liable.

A bus accident can result in serious injuries, including fatalities, as in the Carroll County bus accident. We all hope and pray that we will never find ourselves facing such a horrible tragedy.
