Trucker Awarded Eighty Million Dollars Due to Crash Caused by Negligent Employer

HIDALGO COUNTY, TX – According to an online news report at landinemag.com, a driver of a truck was awarded eighty million dollars after his employer attempted to coerce him to cheat on his logbooks.  The employee was injured as a result of his employer’s negligence.*

A truck driver, who raised allegations that his employer attempted to coerce him into cheating on his log books, was awarded eighty million dollars by a jury in Texas due to injuries he sustained in a crash that occurred in 2015.

On May 7, 2019, a jury in Hidalgo County Texas fined three companies: Anca Transport, Omega Freight Logistics, and JNM Express.  These companies were each fined $25 million.  The jury also awarded the truck driver five million in compensation.

The accident was caused by the employee falling asleep at the wheel on May 6, 2015.  As a result, the man rear-ended another 18-wheeler on Interstate 59 in Alabama.  The employee sustained serious injuries, which included a broken foot, broken ribs, a crushed pelvis, and a traumatic mesenteric hematoma. 

“We had testimony from four former drivers of that company that they were pushed very hard,” said the employee’s attorney.  “They testified that the owner would instruct them to falsify their logs and keep going.  Their employee handbook stated that if they were late with a delivery, they would be fined. If they refused a dispatch, they were going to be terminated.”

Per documents from the court, the employee indicated that right before the accident happened, the truck driver’s employer requested that he change his logbook to make it look as if he was taken the thirty four hour restart so that he could transport produce from San Antonio, Texas to Jessup, Maryland.  The employee indicated that he was afraid he would be fired if he didn’t comply with his employer’s request.
