Sioux City Man Settles Claim with City for $7.5 Million

Sioux City, Iowa- The Macon Telegraph reports that a man from Sioux City, Iowa will receive a $7.5 million settlement as compensation for the life-threatening injuries he suffered in an auto accident with a public transportation bus. The accident happened in November of 2016. The Sioux City council members must vote to approve the deal before the plaintiffs receive any money.*

The primary claimant, Chad Plante, suffered two broken legs and a brain injury when a Sioux City public transportation bus slammed into his SUV on November 15, 2016. The bus driver turned without yielding to Plante, who had the right of way and plowed into him. Police cited the bus driver for refusing to obey a traffic control signal. 

The impact of the crash was so severe that Plante fell into a coma. Plante remained in a coma for several weeks. Once he awoke from the coma, he faced a long, uphill battle to rehabilitate his shattered legs. He would also need to rehabilitate his cognitive process after surviving in a comatose state for so long.

If the City Council approves the settlement, Plante and his wife Rosanne will receive $211,000 from Sioux City and the municipality’s insurance policy will cover the remaining $7.289 million. Corporation counsel for Sioux City recommends that the City Council approve the deal. 

The Plante family never filed a lawsuit in this matter.  Instead, the parties went to mediation before filing any claim in court. 

Mediation can be an effective procedure to resolve disputes when liability is clear, as it was in this case. Alternative dispute resolution practices such as mediation and arbitration can resolve differences quickly and efficiently while helping courts reduce the backlog.  In cases where alternative dispute resolution fails to resolve the matter, trying the case may be necessary.
