Fatal Dump Truck Accident on Fort Argyle Road/204 in Savannah, Georgia
Montlick & Associates, Attorneys at Law Discusses Truck Accident Complexities Following a Fatal Dump Truck Accident in Savannah, Georgia on December 9, 2016
WTOC reported on Friday that Law enforcement, fire, and EMS services were called to an accident scene Friday morning just west of I-95 on Fort Argyle Road/204 in Savannah, GA.
Law enforcement reported that the crash occurred around 7 a.m., on December 9, 2016. The tragic accident involved a Honda Accord and dump truck. Reports state that the male driver of the Accord was traveling eastbound on Fort Argyle Road and the driver of the dump truck was traveling westbound on Fort Argyle Road.
The report states that the driver of the Accord was making a left turn to enter a parking lot in the Gateway Boulevard area. While the driver of the Honda Accord was making the left turn, the driver of the dump truck could not stop the vehicle or maneuver quickly enough to avoid the collision with the Accord. The dump truck "t-boned" the passenger side of the Honda Accord. Unfortunately, there was a passenger in the accord who perished in the accident. Both the driver of the Accord and the dump truck were injured and hospitalized for non-life threatening injuries.
According to the report, MAIT is going to be in charge of the accident investigation to identify the cause of the tragic accident.
Accidents involving dump trucks or large commercial trucks with smaller passenger vehicles are usually much more complicated legal cases. The difference goes beyond the sheer size of the truck alone and its potential to cause larger amounts of damage. When there is an accident involving two passenger vehicles, there are only two parties, the two drivers, involved. When a commercial truck is involved in an accident, there may be other parties involved besides the two drivers. There may also be more than two parties involved in an accident claim because the driver of the truck may not be the owner of the truck, who can also be party to the accident and accordingly held liable. Many times the owner of the commercial truck, dump truck or van is a business entity.
Drivers who are involved in accidents with commercial trucks should be aware that companies who own them will often send an accident response team to investigate the accident scene and collect information on the company's behalf. If you get into an accident with a dump truck or any other commercial truck caused by the driver's negligence, be sure to cooperate fully with the police and other authorities, but also be wary of individuals who are part of an accident response team that is not law enforcement. Those people could be working on behalf of the truck company.
There can be even other parties involved in an accident case, especially if the crash was caused by defective maintenance, defective parts or a manufacturing defect. The array of parties that could potentially be involved in a personal injury case where there has been an accident between a commercial truck and a car can make resolving claims related to those cases rather complicated.
