Officer Hit By Distracted Driver Speaks Out About the Move Over Law

February 07, 2020

DEKALB COUNTY, GA - A police officer was finishing up paperwork after carrying out a traffic stop and was struck by a distracted driver in DeKalb County, according to 11ALIVE.COM. The incident took place in the morning while the officer was on the shoulder of the roadway with his emergency equipment still activated.*

The impact pushed the victim’s vehicle across four traffic lanes, causing a concussion, stitches on his face, and damage to his spine. The car that struck him ended up overturning. After six weeks of recovery time, the officer returned to work and is speaking out about Georgia's Move Over Law and the importance of giving space to responders and officials working on the highway. Pursuant to Georgia law, drivers are required to move over when traveling in the lane next to the shoulder if an emergency or a utility vehicle is present in an official capacity.

The law was enacted in 2003, and officials say that it has helped keep people aware of risks on the roadway. While it is not always possible to change lanes, the law states that if it is not safe or possible to do so, motorists still must slow down. AAA and other safety awareness groups came together to raise awareness of the important law. It is important to use extra caution when people are working on the shoulder of the road, including tow-truck operators and others, who must perform their work next to the flow of traffic. The officer stated that he is lucky to be alive and that his family was shocked by the incident.
