Hurricane Ian

On September 26, 2022, Hurricane Ian became an extremely destructive and deadly Category 4 Hurricane. Its strong winds and storm surge caused more than $60 billion in property damage across Florida, Georgia, and South Carolina. Both residential property and business owners suffered devastating economic and property losses. The most-destroyed regions of the Florida Gulf Coast include properties in Lee County and Fort Myers, Sanibel Island and Captiva Island, Cape Coral, Naples and Collier County, with serious losses also occurring in other gulf coast cities and counties.

Even Central Florida experienced major flooding, affecting Orange County, Florida, which includes Orlando, and even extending north toward Jacksonville. Hurricane Ian was one of the deadliest hurricanes on record. Tragically, at least 120 people were killed in the storm. This loss of life, property and the destruction of communities is absolutely catastrophic.

Florida Residents: What You Need to Know

What Is Florida Statute 627.428?*

Statute 627.428 is a state law that is designed to protect policyholders from being underpaid or wrongfully denied when filing their claim with an insurance company. It is designed to protect consumers and deter insurance companies from wrongfully underpaying or denying valid insurance claims. This statute protects the public from predatory insurance company tactics and holds insurance companies responsible for adequately paying insurance claims.

Are Attorney's Fees Covered if I File a Hurricane Ian Lawsuit in Florida?

Attorney's fees and associated legal costs will be covered by the insurance company if a claimant obtains a "decree" or "judgment" from a Florida Court under Statute 627.428.

The statute states that if your insurance company acts in bad faith, they must pay your claim, your attorney's fees, and all associated legal costs once a court rules in your favor and finds that your insurance company underpaid or wrongfully denied your property damage insurance claim.

Will I Have to Pay the Insurance Company Legal Fees If They Win?

Florida's insurance statute does not require claimants (policyholders) to pay the insurance company's attorney fees or costs should the insurance company win the case.

How Do I Know If My Insurance Company Acted in Bad Faith?

Call us at 1-800-LAW-NEED to discuss your case.

Will the Insurance Company Still Pay My Legal Costs Even If I Don't Go to Trial?

You may also be able to recoup attorney's fees and costs in a property damage claim without having to go through litigation. According to Florida Insurance Laws, payments made by an insurance company (after a lawsuit has been filed) serve as a "confession of judgment." So, if your insurance company consents to pay benefits after a lawsuit has been filed, your attorney's fees and all associated legal costs would be paid by the insurance company without you having to go to trial.
